العربية: مات الوالد وترك زوجة وخمسة أولاد وثلاث بنات، ولازالت أمه على قيد الحياة لكنها مختلة عقليًا، فهل ترث بعد ابنها؟ وكيف يكون ميراث الأم؟
English: A father passed away, leaving a wife, five sons, and three daughters. His mother is still alive but mentally impaired. Does she inherit after her son, and how is the mother’s share determined?
Français: Un père est décédé laissant une épouse, cinq fils et trois filles. Sa mère est encore en vie mais mentalement diminuée. Hérite‑t‑elle après son fils, et quelle est la part de la mère ?

العربية: للزوجة الثمن، وللأم السدس، والباقي للأولاد للذكر مثل حظ الأنثيين. أما كون الأم مختلة عقليًا فليس من شروط الإرث أهلية الوارث، وعليه فهي ترث، ويقوم وليها بحفظ مالها والتصرف فيه. والله أعلم.
English: The wife receives one‑eighth, the mother receives one‑sixth, and the remainder goes to the children, with the male receiving the share of two females. The mother’s mental impairment does not affect her right to inherit. She inherits, and her guardian manages and protects her wealth. And Allah knows best.
Français: L’épouse reçoit un huitième, la mère reçoit un sixième, et le reste revient aux enfants, le garçon recevant la part de deux filles. L’altération mentale de la mère n’affecte pas son droit à l’héritage. Elle hérite, et son tuteur gère et protège ses biens. Et Allah est le plus savant.

العربية: أهلية الوارث ليست شرطًا في الإرث، بل يكفي تحقق سبب الميراث. لذلك ترث الأم ولو كانت مختلة عقليًا، ويقوم وليها بحفظ مالها.
English: Mental capacity is not a condition for inheritance; the cause of inheritance is sufficient. Thus, the mother inherits even if mentally impaired, and her guardian safeguards her wealth.
Français: La capacité mentale n’est pas une condition pour l’héritage ; la cause de l’héritage suffit. Ainsi, la mère hérite même si elle est diminuée mentalement, et son tuteur protège ses biens.
